Counter-Notification: If you believe that your material has been removed or disabled by mistake or misidentification, you may file a counter-notification with our Copyright Agent. Your counter-notification must include:
- Your Contact Information:
- Your name, address, telephone number, and email address.
- Identification of the Material:
- A description of the material that has been removed or to which access has been disabled and the location where the material appeared before it was removed or disabled.
- A Statement of Good Faith:
- A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Consent to Jurisdiction:
- A statement that you consent to the jurisdiction of the federal court in your district or, if you are outside the United States, to the jurisdiction of any judicial district in which ShopMax may be found, and that you will accept service of process from the person who provided the original notification of alleged infringement.
- Your Signature:
- An electronic or physical signature.
Upon receiving a valid counter-notification, we will forward it to the original complainant and reinstate the material in question unless the complainant files a court action against you within 10 business days.
Repeat Infringers: ShopMax reserves the right to terminate the accounts of users who are found to be repeat infringers of copyright.
